FAQ
Can an EMS expert witness use AI to write an expert report?
AI can organize records and draft, but the opinions must be the expert's own, and every fact and citation must be verified. Courts have sanctioned attorneys for AI-hallucinated citations (e.g., Mata v. Avianca, 2023) and excluded expert declarations containing AI-fabricated sources (Kohls v. Ellison, D. Minn. 2025). Disclose AI use where rules or the court require.
Is it safe to upload ePCRs and medical records to AI?
Only to tools with a signed BAA, appropriate security (SOC 2) and contractual no-training terms, consistent with protective orders. Consider privilege and work-product implications before uploading.
What is the best AI for medical record review for litigation?
For chronologies, Supio, ChartSwap Insights and Wisedocs are purpose-built with source-page links. For research, CoCounsel/Westlaw and Lexis+ AI. NotebookLM is a low-cost grounded option for your own documents.
